1. What the service is
TrotterMap is a personal world map: you mark the countries and cities you have visited, and attach photos, documents and notes to them. The service is provided by thanhphm (see the legal notice, available in French).
2. Your account
Creating an account requires a valid email address and a password of at least ten characters. You are responsible for keeping your credentials confidential and for what is done from your account.
The service is not open to people under 15. That is the age from which a person may consent on their own to the processing of their data for an online service (Article 45 of the French Data Protection Act, adopted under Article 8 GDPR). Between 15 and 18, the agreement of a holder of parental authority is required, in particular to take out a subscription and to publish a map. You confirm your age when you register, through a checkbox separate from the one for these terms.
3. Your content
The photos, documents and notes you upload remain yours. They are private by default: nobody but you has access to them, and they are never analysed.
So that the service can work, you grant the publisher the right to host them and display them back to you. If — and only if — you turn on public sharing and mark a memory as visible on your public map, that permission extends to reproducing and displaying that memory on your public page and in the preview image generated for sharing. This licence is free of charge, non-exclusive, limited to that use, and it ends as soon as you remove the memory from sharing or turn off your public map. Your content is put to no other use.
You undertake to upload only content that you hold the rights to and that it is lawful for you to hold. Before publishing a photo, you must also have the agreement of any identifiable people appearing in it: publishing someone else’s image without their permission engages your responsibility, not the publisher’s.
4. Free plan
The free plan gives access to the complete map, to an unlimited number of countries and cities, and to 250 MB of memories. Beyond that, new uploads are refused; memories already uploaded remain accessible. In full screen, photos are displayed in a version reduced to 1600 pixels; the original files can be retrieved at any time by exporting your data.
5. Pro subscription: price and content
The Pro subscription costs €4.99 per month or €39 per year. VAT not applicable, Article 293 B of the French General Tax Code — the prices shown are therefore the final prices.
It adds to the free plan:
- storage of memories with no volume limit;
- display of photos at full resolution, exactly as you uploaded them.
On a public map, full resolution is served only to visitors who are themselves Pro subscribers; others see the version reduced to 1600 pixels. Your own photos are always displayed to you at full resolution.
« No limit » means normal personal use, within a technical ceiling of 250 GB. In the event of use that is manifestly disproportionate to the purpose of the service, the publisher will contact you before taking any measure.
The subscription is not offered to residents of the United Kingdom or the Isle of Man. The free plan remains available everywhere.
6. Payment
Payment is handled by Stripe. No bank details pass through our servers. The subscription is charged in advance, monthly or yearly depending on the plan you choose.
7. Term, renewal and cancellation
The subscription renews automatically at each due date. You can cancel it at any time from ⚙ Settings → Manage, which opens the Stripe portal. Cancellation takes effect at the end of the current period, which has already been paid for: you keep the Pro benefits until then. No data is deleted merely because you return to the free plan; if your memories then exceed 250 MB, they remain accessible but you can no longer add to them.
8. Right of withdrawal
You have fourteen days from subscribing to withdraw, without having to give a reason (Article L221-18 of the French Consumer Code).
By ticking the box provided before payment, you expressly request that the subscription start immediately, without waiting for that period to end. Under Article L221-25 of the same code, if you then withdraw, you remain liable for the amount corresponding to the period already supplied, calculated pro rata; the balance is refunded to you. This request is timestamped and kept together with your payment.
To exercise this right, simply write to contact@thanhphm.fr before the period expires.
9. Availability and backups
The service is provided without any guarantee of uninterrupted availability; interruptions may occur for maintenance or because of a supplier. This takes nothing away from the legal guarantee of conformity for digital services (Articles L224-25-12 et seq. of the French Consumer Code): the service must match what is described here, and it is for us to bring it back into conformity if it does not. Prolonged unavailability gives rise to a right to a price reduction or to termination of the contract.
TrotterMap is not an archiving service: always keep your original photos elsewhere. The database and uploaded files are backed up daily in encrypted form and kept for seven days on a separate server. That is protection against an incident, not a guarantee of archiving. These backups are a means, not an obligation of result; on the other hand, nothing here limits the publisher’s liability for failing to meet its own obligations, nor the rights the law gives you.
10. Deleting your account
You can delete your account at any time from ⚙ Settings → Your data. Deletion is immediate and irreversible: account, visits, memories and files are erased. By itself it does not give rise to a refund of the current subscription period. Your legal rights remain untouched: right of withdrawal (§ 8), legal guarantee of conformity (§ 9), and refunds where the law provides for them. Remember to export your data first.
11. Changes to these terms
These terms may be amended. In the event of a substantial change, subscribers are informed by email before it takes effect and may cancel free of charge.
12. Public sharing, moderation and reporting
Public sharing is optional and off by default. As long as you do not turn it on, your map exists at no public address. Once turned on, your public page shows the countries and cities you have uncovered, your statistics, the pseudonym you chose, and only those photos you marked one by one as public — with their caption, date and location. Neither your email address nor your name appears there. You can remove everything at any time.
Reporting. Anyone, with or without an account, may report published content they consider unlawful or harmful to their rights, from the content reporting page (in French), reachable from every public map. Every report receives an acknowledgement and is examined in a timely, non-arbitrary and objective manner.
Moderation decisions. The publisher may remove published content, switch off the sharing of a map, or suspend an account where the content is unlawful or contrary to these terms. The person who posted the content is informed, together with the reasons for the decision and the means of challenging it — by replying to that message, and in any event before the competent courts. The person who filed the report is informed of the outcome.
These rules correspond to Articles 14, 16 and 17 of the European Digital Services Act.
13. Governing law and disputes
These terms are governed by French law. If you are habitually resident in another country, that choice does not deprive you of any protection afforded to you by the mandatory rules of your country of residence (Article 6(2) of the Rome I Regulation). You may bring proceedings before the courts of your place of residence.
If something goes wrong, write to contact@thanhphm.fr first: most situations are settled that way.
Failing agreement, a consumer may refer the matter free of charge to a consumer mediator (Article L612-1 of the French Consumer Code). The details of the competent mediator will be published on this page as soon as the publisher has joined a scheme; in the meantime, any request sent to contact@thanhphm.fr is handled directly.
14. Language of this contract
The contract was drawn up in French and the French version is the reference text. This English version is a translation, provided so that you can understand what you are agreeing to.
If the two versions differ, the reading that is more favourable to you as a consumer prevails. A translation error is ours, and it is not for you to bear it.
